Terms and Conditions
The owner of the online shop POOD.TAVAST.EE / TOOLS.TAVAST.EU (hereinafter referred to as the Online Store or Online Shop) is Tavast Eesti OÜ (registration number 10680467), located at Kadaka tee 36, Tallinn 10621, Estonia.
Validity of the Sales Agreement, Payment Methods, Goods and Price Information
The terms and conditions of sale apply to the purchase of goods from the Online Shop. The prices of the products sold in the online shop are indicated with the products.
The prices of precious metal materials update every 10 minutes in line with stock market prices. If, for technical reasons, the Online Shop displays prices incorrectly, Tavast Eesti OÜ reserves the right to refuse a transaction with incorrect prices and will refund any money already paid. A delivery fee is added to the price. The delivery fee depends on the location of the buyer and the delivery method. The delivery charge will be displayed to the buyer when placing the order.
Information about the goods is provided on the Online Shop directly next to the goods. The prices on the website are given in euros. Possible payment methods: bank transfer to the current account (including using a bank link), credit cards, and instalments offered by Montonio AS or ESTO AS.
Placing an Order
To order, you must add the products you want to your shopping cart. To place an order, you must fill in the required fields and select the appropriate delivery method. Subsequently, the amount of the fee will be displayed on the screen, which can be paid via bank link or another payment solution.
The contract shall enter into force from the date of receipt of the amount due to the current account of the Online Shop. If the ordered goods cannot be delivered due to the unavailability of the product or for any other reason, the buyer will be notified at the earliest opportunity and the payment made (including delivery costs) will be refunded without delay, usually within 1-2 working days. Depending on the method of payment, the receipt of funds may take up to 7 working days.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland, and Sweden.
The buyer bears the shipping costs and the corresponding price information is displayed alongside the shipping method. Domestic shipments within Estonia generally reach the buyer’s specified destination within 1-7 working days from the commencement of the sales agreement. Outside Estonia, delivery takes place within 3-10 calendar days. In exceptional cases, the right is reserved to deliver the goods within up to 30 calendar days.
If the Online Store has informed the buyer on the website or in the order confirmation of delivery issues and a deadline exceeding 30 calendar days, the deadline published by the Online Store applies.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract made in the e-store within 30 days.
The right of withdrawal does not apply to precious metal products and materials whose price depends on the stock exchange price (Estonian Law of Obligations Act § 53(4)(11)) and to products for which printing or engraving services have been ordered or which have been otherwise adapted to the customer’s wishes, such as cut-to-size wires and sheets (Estonian Law of Obligations Act § 53(4)(2)).
The right of withdrawal does not apply if the buyer is a legal person.
To exercise the 30-day return right, the ordered goods must not be used in any way other than what is necessary to ensure the nature, characteristics, and functioning of the goods, in a manner allowed for testing the product in a physical store.
The returned goods must be:
- in the same completeness and undamaged original packaging as received by the Buyer;
- carefully packaged to prevent damage during transport;
- placed in an additional protective cover (transport packaging, e.g., box or security envelope) or returned in the same transport packaging in which it was originally sent.
If the goods have been used for purposes other than what is necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of use or wear, the Online Shop has the right to reduce the refundable fee in accordance with the reduction in the value of the goods.
To return the goods, a withdrawal statement from the purchase of the goods must be submitted (downloadable here) and sent to the email address pood@tavast.ee no later than 30 days after receiving the goods. The cost of returning the goods is borne by the buyer, except in cases where the reason for the return is due to the fact that the item to be returned does not correspond to what was ordered (e.g., wrong or defective item). The buyer must return the goods within 14 days following the submission of the statement or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Upon receiving the returned goods, the online store will immediately, but no later than 14 days after receiving the withdrawal statement, refund all fees received from the buyer under the contract. The online store may refuse to make refunds until it has received the item that is the subject of the contract or until the buyer has provided proof that they have returned the item, depending on which occurs first. If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.
The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is mistakenly marked significantly below the market price of the goods.
Right to File a Complaint
The online store is responsible for any non-conformity or defect of the goods sold to the buyer, which existed at the time of delivery and which becomes apparent within two years from the delivery of the goods to the buyer. Within the first year from the delivery of the item to the buyer, it is presumed that the defect was present at the time of delivery. It is the responsibility of the Online Store to refute this presumption.
The buyer has the right to contact the online store within two months of the defect becoming apparent by sending an email to pood@tavast.ee or by calling the phone number +372 600 7715.
The online shop is not liable for defects that occur after the goods have been delivered to the buyer. “If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all the fees associated with the sales agreement to the buyer.
The Online Store will respond to the consumer’s complaint in writing or in a format that allows for written reproduction within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer.
The online store transmits personal data to the company providing the transport service to deliver the goods.
The buyer gives their consent to the online store to send notifications about the status of the order.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a desire to do so by entering their email address on the website and has indicated their wish to receive direct mail notifications.
The buyer can opt out of receiving offers and newsletters via email at any time by notifying us via email or by following the instructions provided in the email containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent to the email address pood@tavast.ee or by calling the phone number +372 600 7715.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer has the option to turn to the Consumer Disputes Committee. You can read the terms of the procedure and apply here. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between the buyer and the Online Store. There is no charge for the Commission to examine the buyer’s complaint.
In case of legal disputes, the jurisdiction is Harju County Court, Estonia.
The buyer can turn to the European Union’s consumer dispute resolution platform.
